Winona County Snow Statute
The Winona County Highway Department would like to remind everyone, including commercial snow removal operators, that it is against state law to deposit snow onto a public roadway.
Dumping or plowing snow onto a roadway can create a slippery area or frozen rut or bump, which could contribute to a motor vehicle or pedestrian accident. Piles of snow left on or near the road can freeze into a solid mass creating a hazardous situation for vehicles and snowplows. Piles of snow also increase the chance of snow drifting onto the roadway.
Minnesota Statute prohibits plowing, blowing, shoveling or otherwise placing snow onto public roadways. This includes the shoulder, ditch, and right-of-way area along the roads. It is unlawful push snow out of a driveway into a pile along the opposite side of the road.
The public is cautioned that violations are misdemeanors and additionally civil liability can extend to both the property owner and the person or company who placed the snow improperly.
Winona County would also like to remind anyone working close to a roadway to watch for traffic, and drivers should be alert for people clearing snow.
