Sand Pemit Denied

The Buffalo County Zoning Board of Adjustment Monday night unanimously denied a conditional-use permit for a proposed sand mining project in the Town of Dover.

River Valley Sands, LLC, an association of four landowners in Dover, applied for a permit to mine 24 million tons of frac-sand on about 400 acres of agricultural zoned land.

Landowners seeking the permit were Joe and Karine Klopp, Dale and Patty Powers, John and Sue Birtzer and Errol and Denise Doerr.

A panel of three board of adjustment members voted 3-0 to deny the permit for reasons related to protecting public health, safety and welfare.

Many of the approximate 30 people testifying at a public hearing in front of the board were Dover residents opposed to the project.

The Dover Town Board recommended the zoning board deny the permit and residents said the sand mining and wash plant project conflicted with Dover's land-use planning guide.
