Juhl Wind Lawsuit

Juhl Energy Development Inc. has filed paperwork in U.S. District Court in St. Paul seeking the dismissal of a 3.3 million lawsuit from Unison Co., a South Korean wind turbine manufacturer.

The Pipestone business also is asking the court to "compel arbitration" on the dispute.

According to the online website, Wind Action.org, at issue is a 4.8 million dollar failed wind project built near Altura in Winona County. Juhl Energy  developed the project in 2010 using equipment purchased from Unison, which filed a 16-count lawsuit last month alleging fraud and breach of contract, among other allegations.

In JUHL Development's recent filing, it acknowledges not making payments on the Unison turbines it calls "substandard or otherwise defective."

Winona County Attorney Karin Sonneman said recently Winona County is not a party in the lawsuit but she is keeping an eye on the suit's developments.
