Strip Search Lawsuit



A federal judge has dismissed a lawsuit against two Olmsted County sheriff's deputies accused of conducting an unreasonable strip search.
 
Jonathan Jacobson alleged his rights were violated by searches at the county jail during a 2009 misdemeanor traffic violation investigation.
 
U.S. District Judge Paul Magnuson dismissed the lawsuit Tuesday. Magnuson says a recent Supreme Court decision that expanded strip searches for minor offenses assumes that a strip search is constitutional if it's conducted with a reasonable suspicion that a detainee might be concealing contraband.
 
The lawsuit named deputies James McCormick and Polyxene Voltaire as defendants.  Olmsted County Sheriff Dave Mueller tells the Post-Bulletin of Rochester he's pleased with the dismissal.
