Winona Post--Arnold Lawsuit



The Minnesota Court of Appeals has denied a petition filed by the Winona Post which sought to have a defamation lawsuit filed by the former Winona Area Public School Board Chair dismissed.
                  
In August, District Judge Jeffrey Thompson denied a motion for summary judgement filed by the Post against Stacy Mounce Arnold who filed a civil suit in 2010. Mounce's suit alleged her personal and professional reputation had been damaged by four news articles and an editorial. Arnold had claimed the editorial was a willful and reckless disregard for the truth.
                 
Thompson's August denial meant the case would likely be heard by a jury.  The appeal of Thompson's denial was filed by the Post, the late John Edstrom, Francis Edstrom and former reporter Cynthya Porter.

In their appeal, the plaintiffs claimed Mounce Arnold did not meet her burden of proof that that the Post published false statements about her that conveyed a defamatory meaning.  The appellate court also ruled the district court did not err in denying the Post's request for summary judgement, and therefore no discretionary review was warranted by the appellate court.
