The City Planning Commission prepared the draft agreement which stipulates rules for Biesanz Stone in its mining of frac sand and future expansion of its facilities.
Assistant City Planner Carlos Espinosa says the agreement would address the issue of how near a residential area the facility could get as well as hours of operation and how to deal with dust created from the mining activity.
Biesanz quarry manager Pete Schwab told the council they mine mostly stone and aggregate rock and mining more sand may or not happen, depending on future demand and costs.
The non-conformity use agreement will be brought back to council to vote on at the December 17th meeting or in January according to Espinosa.
