Nisbit Mine Appeal



The Minnesota Court of Appeals has ruled that a full environmental impact statement on Winona County's first and only frack sand mine is not needed.

A group of 12 Winona County citizens had filed an appeal of a 2013 County Board decision to approve the sand mine without the requirement of a full E-I-S.

In a ruling filed on August 6th, the appeals court affirmed the county board's denial of the need for the full E-I-S for the Nisbit sand mine located in Saratoga Township.

The County Board on a 3-to-2 vote in June of 2013 approved the sand mine with 39 conditions saying the full environmental impact statement was not necessary.

The 12 citizens appealed the 19-acre mine approval in light of the mine's potential to negatively affect health, safety and the quality of life.
