A lawsuit filed by the Olmsted County Concerned Citizens group against MinnErgy LLC and the Minnesota Pollution Control Agency was dismissed in Olmsted District Court Monday.
The citizen's group believed the MPCA should have requested an Environmental Impact Statement be completed for MinnErgy's proposed ethanol plant near Eyota, Olmsted District Judge Joseph Chase ruled that the agency
made the right decision.
According to the Rochester Post-Bulletin, a second lawsuit involving the Olmsted County board's decision to approve a rezoning request for MinnErgy could be decided in Olmsted District Court on March 29th.
